Phase I Environmental Site Assessments

Phase I Environmental Site Assessments (ESA) are similar to inspections that are performed prior to making an offer on a home. Just as building inspections are designed to provide potential buyers with information about the property’s structural integrity, Phase I ESAs are designed to provide potential buyers with in-depth information about the history and condition of the land itself.

At Nelson Enviro, our Phase I ESAs are extremely thorough. We examine local and government databases, perform on-site inspections, interview occupants and other stakeholding parties, and use many other resources in order to provide our clients with a thorough list of any recognized environmental conditions that could affect the property.

Desktop Reviews

There are some circumstances in which a full Phase I ESA may provide you with more information than necessary. Our Desktop Review service excludes the on-site analysis and provides you with a detailed rundown of everything we can find in databases and other online sources. Desktop Reviews are an excellent choice for clients who already have some information about the land under a property or who are on a tight schedule. If we do find something that needs to be investigated, we can upgrade the service to include a full-scope Phase I ESA.

Do You Really Need a Phase I ESA?

This is one of the most common questions we receive, and the answer depends on the circumstances of your purchase. If you are purchasing or planning to develop commercial real estate, you will likely be required to have a Phase I ESA performed before the deal or project can proceed.

If you are purchasing a property or developing land that does not explicitly require a Phase I ESA as part of the transition, it is still in your interest to know what you’re getting into. Doing your due diligence could qualify you to defend yourself using CERCLA Innocent Landowner Defense, which limits your liability if the land was contaminated or negatively affected by another party prior to your purchase.

At the end of the day, the answer to this question ultimately depends on the answer to another: How much risk are you willing to tolerate?
